Terms and Conditions
1. Scope of application
These Terms and Conditions apply to all orders placed through the online shop Magna Holz.
They govern the contractual relationship between Magna Holz (hereinafter referred to as “we”, “us”, or “the seller”) and the customer (“you” or “the buyer”).
2. Contract conclusion
By placing an order in our online shop, you make a binding offer to purchase the selected goods.
A contract is formed only when we confirm your order via e-mail (“Order Confirmation”) or when the goods are dispatched.
All product images are for illustration purposes only; slight variations may occur due to natural materials.
3. Prices and payment
All prices are stated in Euro (€) and include Austrian VAT unless otherwise specified.
Shipping costs are displayed separately during checkout.
We accept the following payment methods:
Credit/debit card
PayPal
Stripe
Payment is due immediately upon order completion.
Ownership of the goods remains with Magna Holz until full payment is received.
4. Shipping and delivery
We deliver within Austria and other EU countries.
Delivery times vary depending on stock availability and destination and are displayed during checkout.
Shipping costs depend on weight, destination, and carrier.
If not otherwise stated, delivery typically occurs within 3–10 working days after payment.
If a product is temporarily unavailable, we will inform you immediately and may offer alternatives.
5. Right of withdrawal (cancellation)
Consumers (private customers) have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you or a third party named by you (other than the carrier) received the goods.
To exercise your right of withdrawal, you must notify us (see our contact page)
You can use the standard EU withdrawal form, but this is not mandatory.
Consequences of withdrawal:
If you withdraw from this contract, we will refund all payments received from you (excluding delivery costs beyond standard shipping) without undue delay and at the latest within 10 days after we receive the returned goods.
Refunds will be made using the same payment method you used, unless agreed otherwise.
You must return the goods immediately and no later than 14 days after notifying us of the withdrawal.
You bear the direct cost of returning the goods.
6. Warranty and liability
Austrian warranty law applies.
Wood is a natural product — variations in color, texture, and grain are not defects but characteristics of natural materials.
We are liable only for damages resulting from intent or gross negligence.
Liability for indirect or consequential damages, such as loss of profit, is excluded.
7. Retention of title
The goods remain our property until full payment is received.
8. Data protection
We process your personal data exclusively in accordance with our [Privacy Policy].
Your data will not be shared with third parties except where necessary for contract fulfillment (e.g. payment, shipping).
9. Governing law and jurisdiction
All contracts are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory consumer protections under their country’s laws.
Place of jurisdiction for all disputes arising out of this contract is the competent court in Linz, Austria, unless otherwise required by consumer protection law.
10. Online dispute resolution
Consumers have the opportunity to submit complaints to the EU Online Dispute Resolution Platform:
https://ec.europa.eu/consumers/odr
You may also direct complaints to us via e-mail at [Insert e-mail].
11. Final provisions
Should individual provisions of these Terms and Conditions be or become invalid, the remaining provisions shall remain unaffected.
In place of the invalid provision, the relevant statutory regulation shall apply.
